Terms of Use

1. Scope and Parties

1.1 These Terms of Use ("Terms") govern all use of the KraftCV platform and services ("Service") by customers. The Service is a resume builder designed for tech candidates, offering resume creation, editing, PDF export, AI-powered features, and related functionality.

1.2 The Service is operated by Ekamoira Digital GmbH ("Ekamoira", "Provider", "we" or "us"), a company under Austrian law, registered at FN 553311 v at the Commercial Court Vienna. The Provider and the Customer ("you") agree that only these Terms shall govern the contract.

1.3 Any deviating or supplemental terms of the Customer will not become part of the contract unless we have expressly offered and/or agreed to them in text form.

2. Services Provided by KraftCV

2.1 Core Service: We provide a web-based resume builder platform that enables users to create, edit, and export professional resumes. Features include multiple templates, AI-powered content suggestions, LinkedIn PDF import, GitHub integration, and PDF export. The exact features available depend on your subscription tier (Free or Pro).

2.2 Free Tier: Includes access to free templates, one resume, PDF export without watermarks, and basic features at no cost.

2.3 Pro Tier: Includes all free features plus premium templates, unlimited resumes, AI-powered job description tailoring, ATS analysis, and priority support. Pro features require an active paid subscription.

2.4 Service Modifications: Ekamoira may make reasonable changes to the Service (e.g., to improve performance or comply with laws) provided such changes do not eliminate core features of the Service. We will inform you of any material changes in a timely manner.

2.5 Third-Party Components: If our Service relies on third-party providers or data sources, availability of those external services is outside of Ekamoira's control; if a third-party ceases to provide a necessary component, we will inform you and strive to find a suitable alternative.

2.6 No Guaranteed Results: KraftCV is a tool to help you create professional resumes. We do not guarantee any specific outcomes such as job interviews, offers, or employment.

3. Customer Obligations

3.1 The Customer agrees to use KraftCV only for legitimate purposes and in compliance with all applicable laws. You must keep confidential any login credentials and prevent unauthorized access to the Service. You are responsible for ensuring that any data or content you input into the Service does not infringe any third-party rights or violate any laws.

3.2 Accuracy of Information: You are responsible for the accuracy of the information in your resumes. KraftCV provides AI-powered suggestions, but you should review and verify all content before sharing or submitting your resume.

3.3 Prohibited Uses: You shall not reverse engineer, decompile, or otherwise misuse the Service. You shall not use the Service to generate misleading or fraudulent resume content. In the event of a breach of these obligations, Ekamoira is entitled to temporarily suspend or restrict your access to the Service and/or terminate the contract for cause.

4. Intellectual Property and Data

4.1 Service IP: All intellectual property rights in the KraftCV Service (including the software, templates, algorithms, and documentation) are and remain the exclusive property of Ekamoira. Ekamoira grants the Customer a limited, non-exclusive, non-transferable right to use the Service during the term of the contract.

4.2 Your Resume Data: You retain all rights to the data, content, and materials that you create or provide in KraftCV ("Your Data"). By using the Service, you grant Ekamoira a license to process and use that data only to the extent necessary to provide the Service. We will handle Your Data in compliance with applicable data protection laws and our Privacy Policy. We will not use or share Your Data for any other purposes without your consent.

4.3 Data Export: You may export your resume data as PDF at any time. Upon termination of the contract and upon your request, we will delete your data, except to the extent we are legally required to retain it.

5. Fees, Payment Terms, and Refund Policy

5.1 Free Tier: The free tier of KraftCV is available at no cost. We reserve the right to modify free tier features with reasonable notice.

5.2 Paid Plans: KraftCV offers several paid options: a Lifetime Deal (one-time payment for permanent Pro access), Day Passes (24-hour Pro access), Week Passes (7-day Pro access), and AI credit packs. Fees are as displayed on our pricing page at the time of purchase. All prices include applicable VAT where required by law.

5.3 Payment: Payments are processed through Stripe. By purchasing, you agree to Stripe's terms of service.

5.4 No-Refund Policy: All purchases are final and non-refundable. This includes Lifetime Deals, Day Passes, Week Passes, and AI credit packs. Because our digital products provide immediate access upon purchase, you expressly acknowledge and agree that you waive any right of withdrawal that may otherwise apply under applicable consumer protection laws (including EU Directive 2011/83/EU, Article 16(m)). By completing your purchase, you consent to immediate performance of the contract and acknowledge that your right of withdrawal is lost once access is granted.

5.5 Exceptions: Refunds may be considered at Ekamoira's sole discretion in cases of verified technical failure where the Service was completely unusable and the issue was not resolved within a reasonable timeframe. To request a review, contact us at biz@kraftcv.com within 7 days of purchase with a description of the issue.

6. Limitation of Liability

6.1 Unlimited Liability in Certain Cases: Ekamoira shall be liable without limit in cases of intentional misconduct or gross negligence, and for any damages resulting from injury to life, body, or health caused by any negligence on our part.

6.2 Liability for Slight Negligence: In cases of ordinary (slight) negligence, Ekamoira will only be liable for the breach of essential contractual obligations.

6.3 Exclusion of Other Slight Negligence: Ekamoira shall not be liable for breaches of duty caused by slight negligence if those duties are not essential contractual obligations.

6.4 AI-Generated Content: KraftCV offers AI-powered suggestions and content generation. We do not guarantee the accuracy, completeness, or suitability of AI-generated content. You are solely responsible for reviewing and using any AI-generated suggestions in your resume.

6.5 Indemnification: The Customer shall indemnify and hold Ekamoira harmless from any third-party claims arising out of the Customer's unlawful use of the Service or breach of these Terms.

7. Term and Termination

7.1 Contract Term: The contract begins when you create an account. Free accounts remain active indefinitely. Pro subscriptions renew according to the chosen billing cycle.

7.2 Account Deletion: You may delete your account at any time from your account settings. Upon deletion, all your data will be permanently removed, except where retention is required by law.

7.3 Termination for Cause: Either party may terminate the contract with immediate effect for cause. Cause for Ekamoira includes serious breach of these Terms (such as misuse of the Service) that is not cured after warning. In case of termination for cause, we may immediately suspend your access.

7.4 Effects of Termination: Upon termination, your account will be deactivated. You should export your resume data before termination. All purchases are non-refundable as described in Section 5.4, including upon termination or account deletion.

8. Governing Law and Jurisdiction

8.1 Governing Law: This Agreement shall be governed by the laws of the Republic of Austria, excluding its conflict-of-laws rules and the United Nations Convention on Contracts for the International Sale of Goods (CISG).

8.2 Jurisdiction: The exclusive place of jurisdiction for all disputes arising from or in connection with these Terms shall be Vienna, Austria. This jurisdiction clause does not limit either party's right to seek interim injunctive relief in any appropriate jurisdiction.

9. Final Provisions

9.1 Changes to Terms: Ekamoira reserves the right to modify these Terms. We will notify you of material changes via email or in-app notification. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

9.2 Severability: Should any provision of these Terms be or become invalid or unenforceable, the remainder of the provisions shall remain in effect.

9.3 Contract Language: This English version of the Terms of Use is the binding version. Any translation is for convenience only; in case of inconsistencies, the English text prevails.
